TERMS & CONDITIONS

By making use of the We Clean Bins PTY (LTD) Services and Equipment, you acknowledge that you have read, understood, and agree to the most recent version of these Terms and that you have read, understood, and agree to our Privacy Notice and consent to our collection, processing, storage and sharing certain of your personal information within We Clean Bins in the ordinary course of our business of providing the services to you. Your Personal information will never be sold.

Bin Cleaning

1. We shall clean your Wheelie Bin to the best of our abilities using SABS Approved products and sanitising the wheelie bin for your protection.
2. Should you not be happy with the cleaning, please let us know, and we will come back to clean it again.
3. On the day when your municipality empties your wheelie bin, between 09:00 and 18:00 (in the summer, Sept. through April), and 18:00 (in the winter, May through August), bins are cleaned and sanitised.
4. If your wheelie bin isn’t picked up, which commonly happens when municipal vehicles are late or don’t show up at all, it will be cleaned and sanitised the following day between 9:00 and 16:00, if the wheelie bin is empty.
5. If your waste removal day changes, please let us know via info@wecleanbins.co.za
6. We Clean Bins PTY (LTD), are not responsible for the loss of or damage to the Wheelie Bin:
   1. Where the Wheelie Bin was stolen from the customer’s home;
   2. Where the Customer was negligent in securing the Wheelie Bin; 
   3. Where the Wheelie Bin was damaged intentionally or as a result of gross negligence on the part of the Customer. 
7. If your Wheelie Bin is stolen, you can report the matter to the SAPS, the case number is required for the City of Cape Town to issue you with a new wheelie bin.

We close on these days 

1. We are closed the last week of December, the first week of January and for Easter Friday to and including Easter Monday. We have tried to work during these times, however it’s not viable. Also note that there is no change to the price during our closing times, for our weekly customers, as these are 5-week months.

When is it not possible to wash a Wheelie Bin?

1. We can’t clean bins that has pet faeces, wet paint, engine oil, or any other substance that contaminates water because the substance ruins the water in our machine and filtration. This means we have to throw away up to 450 litres of water right away. 
2. Please make sure that any things that could get into the water are safely bagged and stored in your wheelie bin. 

Payment

1. We will receive your invoice by the 24^th  of the month, and payment is due on the last day of the month.
2. All payments due by the Customer to We Clean Bins PTY (LTD) will be made, without deduction or set-off, using an EFT or via PayFast.
3. Please note, that we rely on your payments to pay employees and support our families, so please make your payments on time.

 Cancellation

1. There are no contracts, this is a month-to-month service.
2. To cancel your service, we ask that you provide us with a month’s notice and you can email: info@wecleanbins.co.za

Users must not use the Website to:

1. conduct any illegal activity;
2. cause annoyance or inconvenience to any person including other Users; or
3. harvest information about Users to send, or to facilitate the sending of, unsolicited commercial electronic messages.
4. Material posted by other Users: We Clean Bins PTY (LTD), is not responsible for and accepts no liability concerning, any Material submitted, uploaded, posted, or transmitted on the Website. 
5. The views and opinions expressed in Material posted by Users on the Sites are the views and opinions of the authors and do not necessarily represent the views or opinions of We Clean Bins PTY (LTD), or its clients. 
6. We Clean Bins PTY (LTD), does not endorse or support any views or opinions posted by Users on the Website or guarantee the accuracy, completeness, currency, or suitability of any information posted by Users.

 Competitions

1. Clean Bins PTY (LTD) may run competitions from time to time on the website. All competitions will be subject to the terms and conditions specific to the competition, which are available to view on the website. To enter the competitions you must accept the terms and conditions of the specific competition.

Age of Users

1. Users must be 18 years or over or otherwise use the Sites with parental or guardian consent and supervision.

Copyright

1. The material on this website is owned by We Clean Bins PTY (LTD),. Users may download information from the Sites and print out that information, but only for their own private, non-commercial use. Otherwise, except as permitted by the Copyright Act 1978, no part of the Sites (including any Material posted on this website) may be reproduced, copied, published, framed, or transmitted in any form or by any means without the prior written consent of WECLEANBINS. 
2. Requests for consent should be directed to We Clean Bins PTY (LTD), at info@wecleanbins.co.za.

 Intellectual Property

1. We (or our associated or affiliated companies or third parties who have licensed its brands to We Clean Bins PTY (LTD), or contributed to the Sites) (“Content Owner”) own, license, or have permission to use from third parties all content of the Sites. 
2. All content of the Sites remains the sole property of the applicable Content Owner and is protected under all relevant copyright, trademark, and other applicable laws. 
3. Nothing on the Sites should be construed as granting any license or rights to use or distribute any content of the Sites outside of the Sites, without our express written agreement or of the other applicable Content Owner.

 Jurisdiction

1. The content, operation, and interpretation of this website and the Terms of Use will be governed by the laws of South Africa. The User agrees to submit to the non-exclusive jurisdiction of the Courts of Cape Town in the event of a dispute arising out of, or in connection with, this website.
2. Changes to these terms and conditions: We Clean Bins PTY (LTD), may amend these terms and conditions from time to time by posting the amended version on this website. It is your responsibility to check these terms and conditions periodically for changes. Subsequent or continuing use of the Sites will constitute acceptance of any changes. If any part of the Terms of Use is or becomes void, it will not affect the validity and enforceability of the remaining provisions. The void part will be replaced by provisions that are valid and have an effect as close as possible to the effect of the void part.

Limitation of liability

1. Although We Clean Bins PTY (LTD) have taken reasonable care to prevent harm or loss to you, you agree that we and our affiliates, shareholders, agents, consultants, or employees (in whose favour this constitutes a stipulation for the benefit of another) are not liable for any direct, indirect, special, incidental or consequential damages or loss of any kind whatsoever or howsoever caused (whether arising under contract, delict or otherwise and whether the loss was actually foreseen or reasonably foreseeable) arising as a result of your use of or inability to use the Services. 
2. You furthermore indemnify us against any damage, damages, liability, claims, or demand by third parties or loss suffered by us arising from your use of the We Clean Bins PTY (LTD)  Services or your breach of these Terms. This indemnity will be subject to any applicable law, including the Consumer Protection Act.

Notices, confirmations, and statements

1. By using our services, you agree that We Clean Bins PTY (LTD) publishing a notice on our website or sending you a notice via email, SMS or post will constitute sufficient notice to you. It is therefore imperative that we always have your most recent personal information updated such as your mobile number, email address, etc.
2. Should you fail to object with us within 5 (five) hours after we sent you a notice (including by email, SMS, or another medium) confirming the request for information or the changing of any setting on your accounts, you will be deemed to have accepted the requests or new setting as being valid and binding in all respects.

No Warranties

1. To the fullest extent permissible by law, including the Consumer Protection Act, no warranties, whether express or implied, are made of any kind in respect of the We Clean Bins PTY (LTD) Services including in respect of the performance, quality, security, content, information, availability, accuracy, safety or reliability of the Services.

 Fraudulent activities

1. We are committed to ensuring the security of your use of the Services and are entitled to investigate any loss suffered by you which is alleged to have occurred due to fraud via the website or telephone service.
2. Where you have been a victim of fraudulent conduct through any use or misuse of the Services, you must inform us as soon as you become aware that suspicious conduct has occurred on your accounts and open a case at your nearest South African Police Service office. You will be required to cooperate with us and the South African Police Service in any investigation conducted into losses that you suffered as a result of such fraud.
3. By using the Websites, you agree to be bound by the Terms of Use as updated from time to time, whether you are a visitor simply browsing the Website or you become a member of the We Clean Bins community (both, “Users”). If you do not agree with any of the terms contained in the Terms of Use, do not use the Websites.

For the purposes of the Terms of Use the word “Websites” includes, without limitation,:

1. this site; all websites, services, or applications owned or provided by We Clean Bins PTY (LTD) and all services offered on or through www.wecleanbins.co.za, and other services accessible via www.wecleannbins.co.za or via other websites owned, operated or provided by We Clean Bins;
2. all mobile phone applications and other media owned, operated, or provided by We Clean Bins; all software offerings and applications owned or provided by We Clean Bins PTY (LTD), and/or available on or through www.wecleanbins.co.za or other websites, mobile phone applications, and other media owned, operated or provided by We Clean Bins PTY (LTD); and all webpages, data, text, images, photographs, graphics, audio, video, and documents including, without limitation, offers and coupons, marketing materials, press releases, white papers, product data sheets, and other information and content on or through or submitted on or through www.wecleanbins.co.za or other websites, mobile phone applications and other media owned, operated or provided by We Clean Bins PTY (LTD).

For the Terms of Use “Related Entity” means any of We Clean Bins PTY (LTD), Joint Venture partners, and Licensees from time to time.

1. Use of the Sites: The Sites are owned, operated, or provided by We Clean Bins PTY (LTD), and are designed to provide a place for Users to access and share homemaker knowledge and experience through forums, articles, videos, and product reviews. The information and material on the Sites are provided “as is” for general informational purposes only. Users access the Sites, and rely on the information and material contained in the Sites, at their own risk.
2. Membership: To participate in certain parts of the website, Users must register on the website as a member of the We Clean Bins PTY (LTD), community. For users who register as a member of the We Clean Bins PTY (LTD), the community must provide We Clean Bins PTY (LTD), with complete and up-to-date registration information, as requested. It is each User’s responsibility to inform We Clean Bins PTY (LTD), of any changes to their registration information, by updating the details on their member profile page. We Clean Bins PTY (LTD), may, in its sole discretion, terminate or suspend Users’ membership the We Clean Bins PTY (LTD).

User-posted content: Some parts of the Websites may allow Users to submit, upload, post or transmit content or material such as text, photos, images, audio, and video (including links to content or material) (“Material”) that may be accessed and viewed by others via the Websites. Users are responsible for any Material they submit to the Sites and must respect the legal rights and sensibilities of other Users. We Clean Bins PTY (LTD), reserve the right to (but have no obligation to) review, remove, edit, modify, deny access to or not display any Material submitted, uploaded, posted, or transmitted to or on the Sites in its sole discretion.

By submitting, uploading, posting, or transmitting Material to or on the Sites, Users:

1. Grant We Clean Bins PTY (LTD), a fully paid, royalty-free, perpetual, transferable, worldwide license to (and to authorise others to) use, copy, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform and display such Material (modified or unmodified) for the purposes of operating the Sites and providing any associated services to Users and any promotional purposes of WECLEANBINS and its clients (for example, WECLEANBINS may reproduce testimonials in promotional materials for its own use or that of its clients (which may or may not include the relevant user name) consent to WECLEANBINS using and publishing (and authorising others to use and publish) their name, character, likeness, image, voice or anything else that identifies them which is contained in the Material for the above purposes.

Grant other Users a royalty-free, fully paid perpetual, worldwide licence to use, copy and reproduce such Material for their own private, non-commercial use.

1. Represent and warrant that they are legally entitled to submit, upload, post or transmit the Material to or on the Website and have obtained all necessary licences, consents, and approvals about the Material (including intellectual property licences and about the use of any name, character, likeness, image, voice or anything else that identifies any person that is included in the Material) to enable them to submit, upload, post or transmit the Material on the Sites and to permit We Clean Bins PTY (LTD), and Users to deal with the Material by the licences granted above without infringement or violation of any third party rights represent and warrant that they provide We Clean Bins PTY (LTD), with accurate, truthful and complete registration information and consent to any act or omission that would otherwise infringe their moral rights in the Material and present and future rights of a similar nature conferred by statute anywhere in the world.

Reporting violations

1. By using the Website, Users may be exposed to Material submitted, uploaded, posted, or transmitted by other Users that may be offensive, indecent, or objectionable. Users agree that We Clean Bins is not liable for the opinions or behaviour of other Users, including any Material they submit, upload, post or transmit on the Sites and any defamatory statements or offensive conduct. Users who believe that the behaviour or Material of another User is objectionable or contrary to the Terms of Use can report the behaviour or Material to We Clean Bins by emailing We Clean Bins PTY (LTD), at info@wecleanbins.co.zaclean you
